Buying building land in the Algarve: six checks before you pay.Bauland an der Algarve kaufen: sechs Prüfungen, bevor Sie zahlen.

A listing that says “terreno” or even “for construction” does not prove you may build. Whether a house of 200 m² or more is allowed depends on how the land is classified, and that is on public record.

1. Is the soil urban or rustic?Ist der Boden urbano oder rústico?

On rustic soil (solo rústico) a new dwelling is, as a rule, not allowed. National law leaves the exceptions to the municipal plan (Decreto Regulamentar 15/2015, article 16). Many cheap plots in the hinterland are rustic, even when the advert talks about a “project” or “potential”. Only urban soil (solo urbano) with a lot that can be built on gives you a clear right to a new house.

2. “A roof must be there”: the existing-building rule„Ein Dach muss da sein“: die Bestandsregel

On rustic land the municipal plans of the Algarve let you rebuild or extend a building that already exists, for housing or rural tourism. They ask for a built structure with a clearly defined volume (estrutura edificada e volumetricamente definida). The law does not use the word “roof”; it is the agents’ shorthand for this test. What counts is that the building is lawful. A pile of stones is usually not enough.

The existing building does not give you free building rights. After the works, the dwelling may not exceed 300 m² in total, or the old floor area if that was larger, and the number of storeys may not grow. A new house of 200 m² next to a ruin is not covered.

3. No building on the plot: the farmer’s houseKein Gebäude auf dem Grundstück: das Haus des Landwirts

Without an existing building, a new house on rustic land is only possible as the home of a farmer running a viable holding. In the plans we read (Loulé, Faro, Portimão, Tavira, São Brás de Alportel, Vila do Bispo) this needs about 10 hectares on the coast and in the Barrocal, 5 hectares in the Serra and in Vila do Bispo, at most 500 m², and a ten-year ban on selling. For a buyer who wants a holiday or retirement home this route is closed in practice.

4. “Urbanizável” is not “buildable today”„Urbanizável“ heißt nicht „heute bebaubar“

Since the 2015 land-use law the category “urbanizable” no longer exists. The regional authority (CCDR Algarve) accepts such land as urban only where it is already serviced or rights are consolidated. If an advert says urbanizável or misto (part urban, part rustic), ask the municipality which part is which, and where the house may stand.

5. Proof of building rights: the prior-information requestDer Nachweis: die Voranfrage

The only binding answer is the municipality’s decision on a prior-information request (informação prévia, article 14 of the RJUE). The law sets 15 days for a general feasibility question and 30 days for specific points; outside bodies and practice make it longer, and one report from Olhão speaks of up to a year. A decision that covers all points can replace the licence if you apply within two years. A listing text, an agent’s word and an approved project that has lapsed (caducado) are not this proof.

6. Timber chalets and holiday letsHolzchalets und Ferienvermietung

Timber houses that stay in place need a permit like any other building. Loulé has reported hundreds of illegal timber structures and opened demolition proceedings in 2025. Whether timber holiday chalets are allowed as rural tourism on rustic land depends on the plan and the holding; new tourism units generally need a larger holding or a rural hotel. Local accommodation (alojamento local) presupposes a lawfully approved dwelling.
